Welcome to Twiddlebit Software Ltd (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our iOS mobile application (“the App”) that allows you to securely access and manage your bank account data. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

Eligibility

  • You must have a valid bank account with a participating financial institution.
  • You must have the legal capacity to enter into these Terms.

Account Registration and Security

  • To use the App, you must create an account and authenticate via your bank using secure OAuth 2.0/Open Banking protocols.
  • You are responsible for keeping your login credentials, authentication devices, and biometrics secure.
  • Do not share your credentials. We are not liable for unauthorized access caused by your failure to secure login information.
  • All accounts are personal; you may not use another person’s account without authorization.

Use of the App

  • The App allows you to view account balances, transactions, and related banking information.
  • You agree to use the App only for lawful purposes and in accordance with these Terms.
  • Prohibited uses include:
    • Attempting to access unauthorized accounts or systems
    • Reverse engineering, decompiling, or copying the App
    • Using the App to commit fraud or transmit malicious code
    • Breaching applicable banking or financial regulations

Privacy and Data Protection

  • Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your personal and financial data.
  • You consent to the processing of your personal and banking information for the purpose of providing and improving the App.
  • We comply with GDPR, PSD2/Open Banking security requirements, and relevant local laws.
  • By using the App, you authorise the App to access your bank account data via participating banks.
  • This authorisation is limited to the data you provide consent for and you may revoke it at any time via the App or your bank.
  • You acknowledge that we do not store your banking credentials; secure tokens are used to access your accounts.

Security and Liability

  • We implement industry-standard security measures to protect your data, but we cannot guarantee absolute security.
  • You are responsible for maintaining device security (e.g., passcodes, biometrics).
  • We are not liable for losses caused by:
    • Unauthorized access due to your failure to secure credentials
    • Bank outages or disruptions in third-party services
    • Use of the App on jailbroken or modified devices

Intellectual Property

  • All content, trademarks, logos, and software in the App are the property of Twiddlebit Software Ltd or its licensors.
  • You may not reproduce, modify, distribute, or create derivative works without prior written consent.

Fees and Payments

  • The App is subscription-based. Any applicable fees will be clearly disclosed before payment.
  • All payments are processed securely through third-party providers; we are not responsible for payment processing errors. Contact the third-party payment provider if you require support.

Termination

  • We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for security reasons.
  • You may also terminate your account at any time via the App.
  • Upon termination, your access to the App will cease, and your data will be handled according to our Privacy Policy and data retention rules.

Updates to Terms

  • We may update these Terms from time to time.
  • Changes will be communicated via the App, AppStore or email.
  • Continued use of the App after updates constitutes acceptance of the new Terms.

Limitation of Liability

  • To the maximum extent permitted by law, Twiddlebit Software Ltd is not liable for any indirect, incidental, or consequential damages arising from use of the App.
  • Our total liability to you for any claim relating to the App shall not exceed the total amount you paid for any subscription or the equivalent in your currency.

Governing Law and Jurisdiction

  • These Terms are governed by the laws of UK.
  • Any disputes will be resolved exclusively in the courts of UK, unless otherwise required by law.

Complaints

  • If you are unhappy with our service, please contact us.
  • We will acknowledge your complaint promptly and aim to resolve it as quickly as possible.
  • As Twiddlebit Software Ltd acts as an agent of Finexer Ltd, complaints relating to account information services, data access, or regulated activities will be handled in coordination with Finexer Ltd.
  • If we are unable to resolve your complaint to your satisfaction, you may be eligible to refer your complaint to the Financial Ombudsman Service (FOS). We will provide further details on how to do this in our final response.
